Welcome to Monsterdex, a self-hosted Discord bot application ("Service" or "Bot") developed and maintained by the Monsterdex Community Team ("Team," "we," "us," or "our") for the purpose of enabling users to engage in the collection, trading, and management of virtual monsters inspired by *My Singing Monsters* (MSM). By accessing, installing, or utilizing the Service within a Discord server or otherwise interacting with its functionalities, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally enforceable agreement between you and the Team. If you do not accept these Terms in their entirety, you are not authorized to use the Service.

 1. Service Overview

Monsterdex is a community-driven, open-source application designed to enhance Discord server engagement through interactive features, including but not limited to:

- The spawning and capture of virtual monsters ("Collectibles") in designated server channels based on user activity.

- The maintenance of individual user inventories for Collectibles.

- The facilitation of trades or transfers of Collectibles between Users.

- The provision of periodic events, seasonal activities, or additional functionalities as determined by the Team.

The Service is offered solely for non-commercial entertainment purposes and does not involve real-world monetary transactions or tangible rewards.

2. Eligibility Requirements

To access and utilize the Service, you must:

- Be at least 13 years of age, in accordance with Discord’s Terms of Service.

- Possess a valid and active Discord account.

- Comply with all applicable laws, regulations, and ordinances in your jurisdiction.

- Agree to the Terms of Service & Privacy Policy

The Team reserves the unilateral right to restrict or terminate access to the Service for any User failing to meet these eligibility criteria or otherwise violating these Terms.

3. User Obligations and Conduct

You agree to use the Service in a manner consistent with its intended purpose and in compliance with the following conditions:

- **Prohibition on Exploits**: You shall not employ third-party software, automated scripts, bots, or any unauthorized methods to manipulate gameplay, including the acquisition, collection, or trading of Collectibles. 

- **No Artificial Activity**: Deliberately inflating server activity (e.g., through excessive messaging or automation) to influence Collectible spawning rates is strictly prohibited.

- **Identity Integrity**: Impersonation of other Users, Team members, moderators, or any individual or entity, whether real or fictional, is not permitted.

- **Account Exclusivity**: Sharing, transferring, or permitting multiple individuals to access your Discord account or Monsterdex inventory is forbidden and may result in suspension or termination.

- **Transaction Finality**: Trades, donations, or transfers of Collectibles executed through Service commands (e.g., `/monster give`) are deemed final, except in cases where the Team determines that an error or violation necessitates reversal.

- **Respectful Engagement**: You shall not utilize the Service to harass, defame, spam, or disseminate inappropriate, offensive, or illegal content within Discord servers.

Non-compliance with these obligations may result in disciplinary actions, including but not limited to warnings, temporary or permanent suspension of access, deletion of Collectibles, or other measures at the Team’s sole discretion.

4. Intellectual Property Rights

- **Service Content**: The Bot, its underlying code, and any original creative elements (e.g., custom graphics or designs, where applicable) are either the property of the Team or licensed under the MIT License (see Section 11). Content inspired by *My Singing Monsters* remains the intellectual property of Big Blue Bubble Inc., and its use within Monsterdex is intended solely for non-commercial, fan-created entertainment purposes.

- **User Rights**: Collectibles acquired through the Service do not confer ownership rights to you; they are digital assets assigned to your Discord account for use exclusively within the Monsterdex ecosystem.

- **Team Authority**: The Team retains the right to modify, reproduce, distribute, or remove any content generated by or within the Service at any time, without prior notice or obligation to Users.

5. Service Modifications

The Team reserves the right to alter, update, suspend, or discontinue the Service, in whole or in part, at its discretion and without advance notification. Such modifications may include changes to Collectible designs, gameplay mechanics, event schedules, or operational features. Your continued use of the Service following such changes constitutes acceptance of the revised Terms.

6. Termination of Access

- **User-Initiated Termination**: You may discontinue use of the Service at any time by removing the Bot from your Discord server or ceasing interaction with its features.

- **Team-Initiated Termination**: The Team may suspend or terminate your access to the Service, including the deletion of associated Collectibles or inventory, for reasons including but not limited to violations of these Terms, misuse of the Service, or operational requirements, with or without prior notice. The Team does not have to provide a reason for termination.

7. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis, with no warranties, whether express, implied, statutory, or otherwise, regarding its functionality, reliability, or suitability for any particular purpose. The Team does not guarantee:

- Continuous, uninterrupted, or error-free operation of the Service.

- Compatibility with all Discord servers, devices, or configurations.

- Resolution of defects, updates, or perpetual availability.

Your use of the Service is at your sole risk, and the Team disclaims any responsibility for outcomes resulting from such use.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Team, its members, affiliates, and contributors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service, including but not limited to:

- Loss of Collectibles, inventory data, or access to the Service.

- Disruptions, conflicts, or damages to Discord servers caused by the Bot.

- Any losses or inconveniences resulting from Service interruptions, modifications, or termination.

This limitation applies regardless of whether the Team has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Team, its members, affiliates, and contributors from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights, including those of Discord or Big Blue Bubble Inc.

10. Third-Party Platforms

The Service operates exclusively within Discord, a third-party platform. You are responsible for adhering to Discord’s Terms of Service and Community Guidelines. The Team bears no liability for actions, outages, or policy changes by Discord that impact the Service’s performance or availability.

11. Open-Source Licensing

Monsterdex is built upon open-source code derived from Ballsdex (available at [https://github.com/laggron42/BallsDex-DiscordBot](https://github.com/laggron42/BallsDex-DiscordBot)) and operates under the MIT License, which states:

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. Users may verify the instance they interact with via the `/about` command; no undisclosed modifications are made to the public codebase.

12. Amendments to Terms

The Team may revise these Terms at its discretion by publishing an updated version on the Monsterdex support server or other official channels. Your continued use of the Service following such amendments signifies your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for updates.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the primary Monsterdex host is located (to be specified by the Team if applicable), without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation between the parties or, if necessary, adjudicated in a court of competent jurisdiction.

15. General Provisions

- **Severability**: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

- **Entire Agreement**: These Terms, alongside the separate Monsterdex Privacy Policy, constitute the complete agreement between you and the Team regarding the Service.

- **No Waiver**: The Team’s failure to enforce any provision of these Terms shall not be construed as a waiver of such provision or any related rights.

By engaging with Monsterdex, you acknowledge its status as a community-driven, non-commercial project intended to foster enjoyment within the My Singing Monsters and Discord ecosystems. We appreciate your participation and commitment to these Terms.
